Terms and Conditions of use of the AfriSam Online Ordering Platform
(“AfriSam ClickToGo”)(“Terms”)

General

These Terms are binding on everyone who chooses to access AfriSam ClickToGo without qualification or exception. By using AfriSam ClickToGo, the person accessing AfriSam ClickToGo (whether in a personal capacity or in a representative capacity for an AfriSam (South Africa) (Pty) Ltd (“AfriSam”) customer (the “User”) agrees to be bound and abide by these Terms, acknowledges to have read and understood them and warrants that they are duly authorised to agree to the Terms and represent the relevant AfriSam customer.

If the User does not agree to any of the Terms, or is not duly authorised to agree to the Terms or represent the relevant AfriSam customer, the User should not enter, view or make use of AfriSam ClickToGo.

Detailed description of products

AfriSam is a manufacturer and supplier of construction materials and cementitious products (“Products”), which Products are supplied to AfriSam’s customers in accordance with AfriSam’s Trading Terms and Conditions of Sale, a copy of which is available on AfriSam’s website, as follows: http://www.afrisam.co.za. In the event of a conflict between the Terms and AfriSam’s Trading Terms and Conditions of Sale, AfriSam’s Trading Terms and Conditions of Sale will prevail.

AfriSam’s customers and/or Users may register for and utilise the functionality of AfriSam ClickToGo in order to:
- View existing AfriSam quotes;
- Place an order with AfriSam from an existing quote;
- View its order history with AfriSam;
- Request pallet returns; and
- View documents and check its AfriSam account status.

The offering on this platform is available to South African Users only.

Privacy policy

The information collected from the User upon registration, and as may otherwise be required during the utilisation of, AfriSam ClickToGo will be processed in line with AfriSam’s Privacy Policy (a copy of which is available on AfriSam’s website (www.afrisam.co.za) and the Protection of Personal Information Act, 2013 (“POPI”).

By using AfriSam ClickToGo, the User consents to (i) AfriSam using such personal information for the purpose for which it has been collected and (ii) AfriSam’s use of third party Operator/s (as defined in POPI), including but not limited to GoBuild Online (Pty) Ltd, to process such personal information (which processing will be in line with the purpose for which it was collected).

Responsibility of AfriSam

AfriSam is responsible for all aspects relating to the sale of the Products sold on AfriSam ClickToGo, customer service and support, dispute resolution and delivery of the Products, in line with AfriSam’s Trading Terms and Conditions of Sale (a copy of which is available on AfriSam’s website, as follows: http://www.afrisam.co.za).

Responsibility of the User
- The User is responsible for: Submitting accurate and up-to-date customer and other details in order to register on AfriSam ClickToGo;
- Ensuring that the Products ordered on AfriSam ClickToGo is what is required by the AfriSam customer. In this regard, AfriSam’s Contact Centre will contact the User and/or the AfriSam customer to confirm the order and delivery details (as applicable);
- Cancelling any order placed for Products which are no longer required, either on AfriSam ClickToGo or telephonically with the AfriSam Contact Centre, and in line with AfriSam’s Trading >Terms and Conditions of Sale (a copy of which is available on AfriSam’s website, as follows: http://www.afrisam.co.za).

Variation

AfriSam may, in its sole discretion, change these Terms or any part thereof at any time. The User thus agrees to review these Terms whenever AfriSam ClickToGo is utilized for any such amendments. Save as expressly provided to the contrary in the Terms, any amended version of the Terms shall supersede and replace all previous versions thereof.
